James Graves Photography – Real Estate Photography Licensing Agreement

This Agreement is entered into between James Graves Photography ("Photographer") and the undersigned Client ("Client") and applies to all photography services provided unless otherwise agreed in writing.

Copyright Ownership

All photographs, videos, drone images, virtual tours, floor plans, and other media created by Photographer remain the sole property of Photographer and are protected by United States Copyright Law.

No copyright ownership is transferred to Client.

License Granted

Upon full payment, Photographer grants Client a limited, non-exclusive, non-transferable license to use the delivered media solely for marketing and advertising the specific property photographed.

Permitted uses include:

  • MLS listings

  • Real estate websites

  • Property brochures and flyers

  • Social media promotion of the property

  • Brokerage marketing related to the property listing

Prohibited Uses

The media may not be:

  • Sold, transferred, assigned, or shared with another agent, brokerage, homeowner, builder, architect, designer, stager, contractor, or third party.

  • Used to market another property.

  • Altered beyond standard cropping and resizing without Photographer's consent.

  • Used after the listing has expired, transferred, or been withdrawn without Photographer's written permission.

Additional licensing may be purchased when needed.

MLS Usage

Client may upload the media to MLS services for the purpose of marketing the property. Copyright ownership remains with Photographer regardless of any MLS terms or conditions.

Payment Terms

Payment is due prior to delivery unless otherwise agreed.

No license is granted until payment has been received in full.

Failure to pay may result in immediate revocation of usage rights.

Delivery

Images are delivered in high-resolution digital format suitable for standard real estate marketing purposes.

Client must notify Photographer of any delivery issues within five (5) business days of receipt.

Cancellation Policy

  • Cancellations more than 24 hours before the appointment: No charge.

  • Cancellations within 24 hours: 25% of scheduled fee.

  • Cancellations within 8 hours or no-shows: 100% of scheduled fee.

Weather & Drone Services

Photographer reserves the right to reschedule due to weather, safety concerns, FAA restrictions, or circumstances beyond Photographer's control.

Portfolio Usage

Photographer may display the media in portfolios, websites, social media, advertising, competitions, and other promotional materials unless otherwise agreed in writing.

Limitation of Liability

Photographer's maximum liability shall not exceed the amount paid by Client for the services provided.

Photographer shall not be liable for indirect, incidental, consequential, or special damages.

Governing Law

This Agreement shall be governed by the laws of the State of New Jersey. Any legal action arising from this Agreement shall be brought in the courts of New Jersey.

Acceptance

By booking services, accepting delivery of media, or submitting payment, Client acknowledges and agrees to the terms of this Agreement.
